1. Agreement to Terms
By accessing or using SafeHoods ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
2. Description of Service
SafeHoods is a disaster preparedness platform that enables community members to register emergency resources and coordinate response efforts. The Service includes:
- Resource registration and management
- Community and pod organization
- User account management
- Communication and coordination tools
- Access for first responders
3. User Accounts
3.1 Account Creation
To use SafeHoods, you must create an account by accepting an invitation from a community or pod administrator. You agree to provide accurate, current, and complete information during registration.
3.2 Account Security
You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
3.3 Account Termination
We may suspend or terminate your account if you violate these Terms or if your community administrator removes your access. You may also request deletion of your account at any time.
4. User Responsibilities
By using SafeHoods, you agree to:
- Provide accurate information about yourself and your resources
- Keep your resource information up to date
- Use the Service only for its intended purpose of disaster preparedness
- Respect the privacy of other users
- Not share your login credentials with others
- Not attempt to access data or features you are not authorized to use
- Not use the Service for any unlawful purpose
5. Resource Registration
5.1 Voluntary Participation
Registration of resources is voluntary. By registering a resource, you indicate a willingness to potentially share that resource during emergencies, but you are not obligated to do so.
5.2 Accuracy of Information
You are responsible for ensuring the accuracy of resource information you provide. Inaccurate information may hinder emergency response efforts.
5.3 No Guarantees
The availability of registered resources during emergencies is not guaranteed. Resource owners may be unavailable, resources may be in use, or circumstances may prevent sharing.
6. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- WARRANTIES OF MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- AVAILABILITY OR RELIABILITY OF THE SERVICE
We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAFEHOODS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, use, goodwill, or other intangible losses
- Damages resulting from your use or inability to use the Service
- Damages resulting from unauthorized access to or alteration of your data
- Damages resulting from the conduct of any third party on the Service
8. Not a Replacement for Emergency Services
SAFEHOODS IS NOT A SUBSTITUTE FOR PROFESSIONAL EMERGENCY SERVICES.
In any emergency situation, you should:
- Call 911 or your local emergency number first
- Follow instructions from emergency management officials
- Not rely solely on SafeHoods for emergency response
SafeHoods is a supplementary tool to enhance community preparedness and neighbor-to-neighbor assistance, not a replacement for professional emergency response.
9. Intellectual Property
The Service and its original content, features, and functionality are owned by SafeHoods and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.
10. Indemnification
You agree to indemnify, defend, and hold harmless SafeHoods and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Information you provide through the Service
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Canada and the Province of British Columbia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of British Columbia.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
